Welcome to SHUAFAY, operated by SHUAFAY INDUSTRIES (“SHUAFAY”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your use of shuafay.com, covering both SHUAFAY apparel & accessories and SHUAFAY Studios digital services. By accessing our site, creating an account, placing an order, or uploading content, you agree to these Terms and related policies (Privacy, Returns, Delivery, Security). If you do not agree, please refrain from using our services.

1) Who we are

• Parent Company: SHUAFAY INDUSTRIES

• Divisions: SHUAFAY (fashion & leatherwear) and SHUAFAY Studios (digital services)

• Domain: All businesses operate under shuafay.com

2) Accounts & eligibility

• You must be at least 18 years old or of legal age in your jurisdiction to create an account or place an order.

• You are responsible for maintaining the confidentiality of your login credentials.

• We may suspend or terminate accounts suspected of fraud, misuse, or abusive behavior.

3) Your content & license

By uploading content (e.g., images, designs, reviews), you confirm you own or have rights to use it. You grant SHUAFAY a worldwide, royalty-free, transferable license to use, reproduce, and display it for order fulfillment, support, and marketing. This does not affect your original ownership. Derivatives created by SHUAFAY may be protected by our rights.

4) Product info, availability & color accuracy

We aim for precision in descriptions, but specifications, prices, and availability are subject to change. Colors may vary due to display differences and are not considered defects.

5) Orders, payment & pricing

• Orders may be limited or refused (e.g., suspected fraud, incorrect pricing, limited stock).

• Prices may exclude taxes, customs duties, or shipping unless stated.

• Global trusted payments: Visa, MasterCard, UnionPay, and secure bank transfers.

• Encryption & anti-fraud: All transactions are protected with SSL encryption, malware scanning, and fraud detection.

6) Shipping & risk of loss

We ship to the address provided at checkout, subject to carrier limitations. Risk of loss passes upon carrier acceptance. Claims must be filed with the carrier; SHUAFAY may assist.

7) Cancellations, returns & inspections

• Cancellation: Orders may be cancelled before dispatch (within 3 days) for a refund.

• Returns: Items may be returned within 14 days, unused and with original packaging.

• Fees: Return shipping is customer’s responsibility unless faulty.

• Exclusions: Personalized or made-to-order goods are not returnable.

• Fair use: Accounts showing serial return abuse may face restrictions.

8) Custom & made-to-order

Custom products cannot usually be cancelled or returned. Customers must ensure they have rights to requested designs. SHUAFAY may refuse orders that infringe others’ IP.

9) Wallet ecosystem (USD, GBP, EUR, AED, PKR)

• A loyalty & discount system, not a bank account or payment gateway.

• Segregated balances in USD, GBP, EUR, AED, PKR.

• Partial redemption only, not full cart coverage.

• Transfers: Wallet-to-wallet permitted, fees may apply.

• Bonuses: Promotional credits may be issued, non-refundable.

• Fraud & compliance: SHUAFAY may freeze accounts or request verification for suspicious activity.

10) SHUAFAY Studios (digital services)

• Scope: Web development, SEO, optimization, photo/video editing.

• Engagement: Governed by Statements of Work (SOWs).

• Fees: 50% upfront, 50% on delivery.

• IP rights: Delivered assets licensed/assigned on payment, excluding pre-existing tools.

11) Intellectual property

All content (logos, text, designs, graphics, photos) is owned or licensed by SHUAFAY. Unauthorized copying, resale, scraping, framing, or reproduction is prohibited.

12) Acceptable use

You agree not to misuse our site for fraud, hacking, scraping, reverse engineering, unlawful uploads, or abusive behavior.

13) Promotions & vouchers

Promo codes and wallet bonuses are non-transferable, subject to conditions, and may be modified or withdrawn without notice.

14) Third-party links

Links to external sites are for convenience. SHUAFAY is not responsible for their policies or content.

15) Security, privacy & reCAPTCHA

• Protection: SSL encryption, firewalls, malware scanning, CDN security, and fraud detection safeguard all transactions.

• reCAPTCHA: Google reCAPTCHA v3 protects our site (with fallback to v2). Badge is hidden for UI clarity but full disclosure is provided here:

  “This site is protected by reCAPTCHA and the Google Privacy Policy and Terms of Service apply.”

• Privacy: Governed by our Privacy Policy.

16) Resale & commercial use

Purchases are for personal use only. SHUAFAY reserves the right to limit or cancel orders suspected of being intended for unauthorized resale or distribution.

17) Warranties & disclaimers

Products/services are provided “as is.” To the extent permitted by law, SHUAFAY disclaims implied warranties of merchantability, fitness, or non-infringement.

18) Limitation of liability

SHUAFAY is not liable for indirect, incidental, or consequential damages. Liability shall not exceed the purchase price of the product/service in question.

19) Force majeure

We are not responsible for delays or failures caused by events beyond our control, including natural disasters, strikes, cyberattacks, or government restrictions.

21) Accessibility

Customers are responsible for import/export compliance and paying duties/taxes at delivery.

23) Governing law & disputes

These Terms are governed by Pakistan law, with disputes subject to Karachi courts, unless mandatory protections in your country apply.
