Welcome to SHUAFAY, operated by SHUAFAY INDUSTRIES (“SHUAFAY”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of shuafay.com, including all associated services, content, features, and transactions.

By accessing our website, creating an account, placing an order, engaging our services, or uploading content, you agree to be bound by these Terms and all related policies, including our Privacy Policy, Refunds & Returns Policy, and Shipping & Delivery Policy. If you do not agree, please do not use our platform.

• SHUAFAY Studios – Digital, creative, and technology services

All current and future businesses, services, and brand divisions operate under the unified domain shuafay.com.

2. Eligibility & Account Responsibility

You must be legally capable of entering into a binding contract to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.

SHUAFAY reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.

3. Your Content & License

When you upload or submit any content (including images, measurements, designs, files, or instructions), you confirm that you own the rights or have valid permission to use such content.

You grant SHUAFAY a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, display, and distribute such content for purposes including order fulfillment, quality control, customer support, marketing, and internal operations.

This license does not transfer ownership of your original content.

4. Product Information, Availability & Accuracy

We strive to display accurate descriptions, specifications, and pricing. However:

• Product details, availability, and prices may change without notice

• Minor variations in color, texture, or finish may occur due to screen differences and material characteristics

• Such variations do not constitute defects

Errors may occasionally occur; SHUAFAY reserves the right to correct inaccuracies and cancel affected orders.

5. Orders, Payments & Pricing

We reserve the right to:

• Limit quantities

• Refuse or cancel orders

• Cancel orders due to pricing errors, inventory issues, or suspected fraud

Prices may exclude shipping, customs duties, VAT/GST, or import taxes unless stated otherwise.

United States customers: State sales or use tax may apply even if not collected at checkout; customers are responsible for compliance.

6. Shipping, Risk & Delivery

Orders are shipped to the address provided at checkout using trusted carriers (e.g., DHL, UPS).

• Risk of loss transfers to you once the shipment is accepted by the carrier

• Delivery timelines are estimates and may vary due to customs, remote areas, or external factors

7. Cancellations, Returns & Inspections

Cancellations:

Orders may be cancelled before dispatch (typically within 1 day) for a full refund.

Returns:

Eligible items may be returned within 14-30 days of delivery, provided they are unused, unaltered, and returned with original packaging and tags.

All returns are subject to inspection before approval.

Return shipping costs are the customer’s responsibility unless the item is faulty or required by law.

EU/EEA customers: Statutory 14-day withdrawal rights apply except for exempt items (e.g., Made-to-Order).

Abusive or excessive return behavior may result in account restrictions while respecting statutory rights.

8. Made-to-Order & Custom Products

Made-to-Order, customized, or bespoke products are produced specifically for you and are non-returnable and non-refundable once production begins.

If you request replication of third-party designs, you are solely responsible for ensuring intellectual property rights. SHUAFAY may refuse orders that appear to infringe third-party rights.

9. SHUAFAY Wallet Ecosystem

SHUAFAY offers a wallet-based loyalty and discount system.

Key terms:

• Supported currencies: USD, GBP, EUR, AED, PKR

• Wallets are not bank accounts, e-money, or payment gateways

• Wallet balances are non-interest-bearing and non-withdrawable

• Partial redemption only (wallet cannot cover 100% of an order)

• Promotional bonuses are subject to specific terms and may expire

• Wallet-to-wallet transfers may incur fees

SHUAFAY reserves the right to limit, freeze, or investigate wallets in cases of fraud, abuse, or legal compliance requirements.

10. SHUAFAY Studios (Digital Services)

Scope:

Includes web development, ecommerce solutions, SEO, performance optimization, and creative services.

Engagement:

Deliverables, timelines, and revisions are governed by an agreed proposal or Statement of Work (SOW).

Payments:

Typically 50% upfront and 50% upon delivery or acceptance, unless otherwise agreed.

Intellectual Property:

Upon full payment, clients receive rights as defined in the SOW, excluding SHUAFAY’s pre-existing tools and licensed assets.

11. Intellectual Property Rights

All website content, branding, logos, text, images, and designs are owned by or licensed to SHUAFAY and protected by intellectual property laws.

Unauthorized copying, scraping, framing, or commercial use is strictly prohibited.

12. Acceptable Use

You agree not to:

• Engage in fraud, abuse, or unlawful activity

• Attempt to breach security or systems

• Upload infringing, defamatory, or harmful content

We reserve the right to remove content and cooperate with law enforcement where required.

13. Promotions & Offers

Promotions, voucher codes, and wallet bonuses are subject to published rules, time limits, and availability. SHUAFAY may modify or withdraw promotions in cases of error, abuse, or regulatory requirements.

14. Disclaimers & Limitation of Liability

To the maximum extent permitted by law:

• Services are provided “as is” and “as available”

• SHUAFAY disclaims implied warranties including merchantability and fitness for purpose

• SHUAFAY shall not be liable for indirect, incidental, or consequential damages

Nothing limits liability where prohibited by law.

15. Taxes, Duties & Compliance

You are responsible for complying with all local laws, import regulations, sanctions, and tax obligations applicable in your jurisdiction.

Customs duties, VAT/GST, or import taxes are payable by the buyer under our DDU shipping model.

16. Governing Law & Disputes

These Terms are governed by the laws of Pakistan. Exclusive jurisdiction lies with the competent courts of Karachi, Sindh, except where mandatory consumer protections apply in your country of residence.

We encourage amicable resolution prior to legal proceedings.

17. Changes to These Terms

SHUAFAY may update these Terms at any time. Changes take effect once published with an updated date. Continued use of our services constitutes acceptance.
